Commentary by Attorney Michael Grossman
When a vehicle strikes a guardrail, overcorrects, and then leaves the road again, it suggests a complex sequence of events rather than a single mistake. The real question is whether investigators will fully examine why control was lost in the first place and why the crash escalated so severely.
Did the authorities thoroughly investigate the crash?
A crash involving multiple impacts and an eventual fire requires precise reconstruction. Investigators should document the first point of contact with the guardrail, measure skid or yaw marks across the lanes, and map the vehicle’s final trajectory into the tree. Overcorrection often leaves clear evidence in tire marks, which can show how abrupt the steering input was. Without that level of detail, it’s difficult to determine whether this was driver input alone or if another factor played a role.
Has anyone looked into the possibility that a vehicle defect caused the crash?
Mechanical issues—such as steering failure, brake malfunction, or a tire blowout—could explain why the vehicle left the roadway to begin with. Likewise, stability or suspension problems can make overcorrection far more likely to cause a rollover or secondary impact. The fire also raises concerns about whether a defect in the fuel system contributed. A thorough inspection of the vehicle is necessary before ruling these possibilities out.
Has all the electronic data relating to the crash been collected?
Most modern vehicles capture critical pre-crash information, including speed, braking, and steering inputs. Reviewing this data could help confirm whether the driver tried to regain control or if the vehicle responded unpredictably. Traffic cameras, dashcams, or nearby surveillance footage may also provide an independent record of the sequence of events. Preserving this evidence quickly is key.
Understanding a crash like this requires tying together scene documentation, mechanical inspections, and electronic data so no potential cause is overlooked.
Takeaways:
- Multi-impact crashes demand careful reconstruction to understand how the sequence unfolded.
- Mechanical inspections are necessary to confirm or rule out failures that contributed to loss of control or fire.
- Event data and video evidence can provide clear insight into the driver’s actions and vehicle behavior.
