Commentary by Attorney Michael Grossman
When a single-vehicle accident results in a fatality, it is essential to approach the investigation with a focus on understanding the contributing factors without making any assumptions about fault. To uncover the full story, three critical questions must be addressed: Did the authorities conduct a thorough investigation? Has the possibility of a vehicle defect been considered? Has all relevant electronic data been preserved and analyzed?
The first question concerns whether the authorities conducted a thorough and comprehensive investigation. Factors such as roadway conditions, weather, signage, and potential hazards must be carefully examined. Was the road properly maintained? Were there environmental factors like debris or ice that may have impacted the vehicle’s stability? Ensuring that all these elements are evaluated is key to developing a complete understanding of the incident. Independent experts may need to analyze physical evidence, such as tire marks and crash dynamics, to identify any contributing factors that could have been overlooked.
The second question involves whether a mechanical defect or maintenance issue played a role in the incident. Vehicles are complex machines, and failures in critical systems—such as steering, brakes, or tires—can lead to loss of control. Additionally, safety systems like seatbelts and airbags should be examined to determine if they functioned properly and provided adequate protection. A thorough inspection by qualified professionals can identify any potential defects or maintenance issues that may have contributed to the crash or its outcome.
The third question focuses on the collection and preservation of electronic data from the vehicle. Modern vehicles are equipped with electronic control modules (ECMs) that record key information, such as speed, braking, and steering inputs leading up to the crash. This data can provide invaluable insight into the vehicle's operation and performance. However, it is crucial to secure this data promptly, as it can be lost or overwritten if not preserved correctly. Ensuring that this evidence is analyzed is a critical step in reconstructing the events surrounding the crash.
Answering these questions requires collaboration between legal professionals, crash reconstruction experts, and engineers to ensure a thorough and unbiased investigation. While law enforcement’s initial work serves as a foundation, independent reviews often reveal details that help clarify what occurred and identify all contributing factors.
By addressing these three critical questions, it becomes possible to uncover a clear and accurate understanding of the incident. These steps ensure that all potential factors are explored and help provide clarity and accountability where it is needed most.
