Commentary by Attorney Michael Grossman
When two 18-wheelers collide and leave the roadway, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this rarely occur without multiple contributing factors that need to be examined.
What caused the initial collision? Professional drivers are trained to maintain safe distances and anticipate traffic patterns, so investigators need to determine why these two trucks made contact. Did one driver make an unsafe lane change? Was distraction or fatigue involved? Investigators should review black box data, dashcam footage, and witness statements to determine the sequence of events leading up to the crash.
Why did both trucks veer off the roadway? Trucks are designed for stability, and experienced drivers know how to correct minor impacts. Investigators need to determine whether excessive speed, an overcorrection, or improper cargo loading contributed to the trucks losing control. Reviewing skid marks, vehicle positioning, and cargo weight distribution could provide insight.
Did the trucking companies play a role? Trucking companies are responsible for ensuring their drivers are properly trained and following safety regulations. If either driver was fatigued, operating under unrealistic deadlines, or driving a truck with known mechanical issues, investigators need to uncover those details. Reviewing company policies, driver logs, and past violations could provide insight into whether broader issues contributed.
Why is one driver facing charges? The fact that one driver has been charged with negligent homicide, failure to drive in a proper lane, and making a false statement suggests investigators found evidence of unsafe driving behavior. It’s unclear what specific actions led to these charges, but reviewing crash reconstruction reports, cell phone records, and driver testimony will likely shed light on the role this driver played in the wreck.
At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity and closure they deserve.
