Commentary by Attorney Michael Grossman
The chaos following a serious fatal crash like this can present more challenges than people may realize. Many will just assume authorities had a crack CSI team out at the scene to map things out and preserve evidence. In my experience, though, a lot of department put accident reconstruction low on their list of priorities. It’s sometimes crucial, then, to follow up and find out what exactly authorities did and didn’t look into.
Did investigators laser map the crash scene? Did they document debris patterns? Did they investigate for vehicle defects, either that may have caused the crash or that may have resulted in unusually severe injuries (a faulty airbag, for example)? Did they look for nearby businesses or residences that may have had security systems with a view of the road? Did they pull cell phone records or examine vehicle data? Was alcohol or medical history considered? Have they examined the design of the road?
Even unlikely possible factors are important to consider—especially when someone loses their life. At the end of the day, victims and families deserve to know all sides of the story are being told fairly. That means gathering as much evidence as possible and letting the facts speak for themselves. Did that ever happen here?
