Commentary by Attorney Michael Grossman
Authorities said they believe Martinez was under the influence of alcohol at the time of the crash, but I wouldn't take that at face value based solely on the few details released to the public. I've seen plenty of wrecks similar to this one where authorities suspected intoxicated driving only for evidence to show something else entirely led to the crash—fatigue, tire blowouts, hit-and-runs, medical emergencies, etc. But even if evidence does confirm alcohol was a factor here, that doesn't necessarily mean that's the end of the story.
What few realize is that in Texas it's illegal for a bar to over-serve alcohol to their customers. Oftentimes when I'm litigating a personal injury or wrongful death case against the bar, there's a parallel criminal case against the bartender. I don't know if authorities are pursuing that angle with this crash, but I hope that's something they're looking into.
