Commentary by Attorney Michael Grossman
With a single-vehicle wreck like this, it’s important to know how thorough investigators are being in their efforts. People tend to think these accidents are simple since there’s just one vehicle involved. But that fact itself is sometimes the reason authorities treat single-vehicle accidents as a low priority. When authorities are too hasty in their efforts, that’s when important details slip through the cracks.
For instance, I had a case a while back where a family sought a second opinion on the police reports they received about a loved one’s accident. The reports claimed their loved one wasn’t wearing a seatbelt, which was said to have contributed to their injuries. However, the family was adamant that their loved one always wore their seatbelt, and it didn’t make sense to them. After conducting a more detailed independent investigation, it was revealed that the seatbelt was defective. The pretensioner had failed, allowing the victim to be thrown from their seat despite being properly buckled in. Had the seatbelt worked as intended, the victim likely would have avoided serious injury.
I’m not saying anything like that happened here, just to be clear. My point is that when accidents are treated flippantly, authorities might overlook something important that even those involved in the crash didn’t know about. Whether or not anything like that happened here may be up to more thorough independent investigations to say.
