Authorities said that 40-year-old David Edward Spaulding was in a Subaru Crosstrek which was traveling eastbound along Little York. From behind, it appears an Infiniti sedan rear-ended Spaulding. Spaulding reportedly sustained serious injuries in the crash. The other driver’s condition wasn’t specified, but authorities said that person was taken to a hospital, as well.

Right now, alcohol is listed as a possible contributing factor, but there were also claims that the Infiniti driver may have left the scene of the accident at some point. Could that be why there’s no confirmation on whether or not the driver who hit Mr. Spaulding was drunk? If authorities weren’t able to get a blood-alcohol content (BAC) test result, there could be concerns about how to prove if alcohol was a factor or not. But there are other ways to accomplish this which don’t always get proper consideration.

For example, in the hundreds of personal injury cases our firm has handled against bars and other alcohol providers complicit in alcohol-related accidents, we were required to prove a driver was intoxicated. Time and time again, we could do so even without BAC test results. Receipts, credit card statements, security video, witness statements, testimony from medical experts, and even texts and social media posts are all useful tools that can help prove that someone must have been intoxicated at a given moment in time.

Regardless of what happened in this crash, did authorities consider these other potential avenues? If not, there could still be more to this story.
