Commentary by Attorney Michael Grossman
When a single-vehicle rollover crash results in serious injuries, especially in the early morning hours like this one along Interstate 20, people often assume the driver simply drifted or overcorrected. But from what I’ve seen, those assumptions can miss important details that may explain why the crash happened in the first place. To get a complete understanding, there are three questions that should be asked in every serious accident like this.
First, did the authorities conduct a thorough investigation? A crash around 3:15 a.m. brings challenges—low visibility, limited traffic, and sometimes incomplete documentation. Investigators should evaluate whether the road design, surface conditions, or lane markings may have contributed to the vehicle striking the median. Did the vehicle veer abruptly, or was it a gradual drift? Were there signs the driver attempted to correct course? Many departments do what they can with limited resources, but without a full reconstruction, key details may go unexamined. That’s where an independent review can make a significant difference.
Second, has anyone looked into whether a vehicle defect might have contributed to the crash? A Toyota 4Runner overturning after hitting a barrier raises questions. Did the steering respond as expected? Were the brakes functioning properly? Could something in the suspension or electronic stability control system have failed? These are not issues that show up in a visual inspection—they require a detailed forensic examination, which is only possible if the vehicle is preserved and not quickly repaired or scrapped.
Lastly, has all available electronic data been collected? Most modern vehicles, including the 4Runner, are equipped with event data recorders that store key information like speed, throttle input, braking, and steering activity in the seconds before a crash. That data can help determine whether the vehicle behaved as it should have and whether the driver attempted to avoid the barrier. Additional context, such as GPS data or nearby surveillance footage, may also be useful. But as with all digital evidence, this information is time-sensitive and must be preserved quickly.
When the cause of a crash is uncertain and someone is seriously hurt, it’s not enough to settle for surface-level conclusions. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
