Commentary by Attorney Michael Grossman

This crash raises several important questions about how and why the Chevrolet Bolt was driving on the shoulder and grass before colliding with the Ford Taurus. While this detail immediately points to unusual and dangerous driving behavior, understanding why it occurred is key to determining responsibility and whether this incident could have been avoided.

One critical area of focus is the actions of the Chevrolet Bolt driver. Driving off the roadway is highly irregular, and investigators should examine whether distraction, impairment, fatigue or a medical emergency played a role. As the driver was working for a ride-hailing service, it’s worth asking whether factors like tight schedules, app notifications or pressure to meet customer demands contributed to the crash. Ride-hailing companies often operate in ways that may encourage drivers to take risks, even if unintentionally.

Another consideration is whether the Chevrolet Bolt itself had any mechanical issues. A sudden failure, such as brake problems or a stuck accelerator, could explain why the driver left the roadway and was unable to regain control. Investigators will need to carefully inspect the vehicle to rule out such possibilities.

For the Ford Taurus driver, this crash highlights the vulnerability of drivers who are simply following the rules of the road when another vehicle behaves unpredictably. Based on the description, it seems unlikely the Taurus driver could have done anything to avoid being struck. However, investigators should confirm whether the road design or traffic conditions at the intersection played any role in the crash. For instance, was the shoulder wide enough to accommodate safe navigation, and were there clear signs or barriers discouraging improper use of the shoulder?

The broader question involves the policies and practices of ride-hailing services. While individual drivers are responsible for their actions, companies have a duty to ensure that their operations prioritize safety. This includes training drivers to manage the unique demands of transporting passengers and designing systems that don’t incentivize risky driving behavior. If systemic issues contributed to this driver’s actions, the company’s role in this crash warrants scrutiny.

Ultimately, crashes like this underscore the importance of examining all contributing factors: not just driver behavior but also vehicle condition, roadway environment and the systems under which drivers operate. While nothing can undo the victim’s death, a thorough investigation can help ensure that those responsible are held accountable.
