Commentary by Attorney Michael Grossman
If inattention was indeed a factor here, that probably aligns with a lot of people's first guess at what causes most car accidents: cellphone usage. This highlights the importance of securing electronic evidence as early as possible. Cellphone data is the obvious one, but this also includes vehicle data, GPS information, and also any possible video footage of the crash (a lot of residences and businesses have security cameras these days). Electronic evidence often gets overwritten or erased, so it can be time-sensitive. If authorities haven't already taken steps to secure this evidence, they could be letting crucial information slip through the cracks.
