Commentary by Attorney Michael Grossman
Authorities are clearly taking this situation seriously, and if their allegations prove to be true, then consequences are obviously warranted. Depending on the truck driver's employment status, though, the scope of those consequences could change dramatically. There may not be that much authorities can do for a negligent independent owner-operator besides addressing their actions surrounding the crash itself. When employers are introduced into the mix, though, it gives rise to the concern of how they conduct their day to day business and whether or not this crash was preventable.
If a driver makes serious mistakes while employed by a company, it brings up two concerning possible scenarios. The first possibility is that there were red flags of a truck driver's behavior that could predictably lead to an accident, but the company failed to identify those warning signs. The second, potentially more alarming scenario is that the company knew about the reckless behavior but did nothing about it. In either scenario, that company's behavior could continue putting lives at risk, and inevitably it would lead to more harm in the future.
That's why it's important after these truck wrecks to get the whole story. After all, if there's going to be accountability for a serious truck wreck, why wouldn't it be for all responsible parties? One allegedly recklessly driver may be off the road for now. It would be prudent to know if there are others like him still putting lives at risk.
