Commentary by Attorney Michael Grossman
With an accident like this, things generally will focus on whether or not the stationary vehicle was visible and reasonably avoidable. If evidence shows it was too dark out, and the victim's vehicle had no lights on and wasn't clearly visible, an approaching driver might not have a chance to avoid them.
However, if evidence instead shows the victim and the stationary vehicle were well-lit and/or were safely out of the way of lanes of travel, it would be a huge red flag about what prevented the approaching driver from hitting them. Hopefully authorities were more thorough behind the scenes, as the current statements on this crash leave far more questions than answers.
