Commentary by Attorney Michael Grossman
Collisions on private property are sometimes treated as unusual or one-off events, but they still raise important questions about how they happened and whether every factor has been accounted for. In a case where a dirt bike strikes someone in a field, the investigation should focus on more than just the immediate description.
1. Did the authorities thoroughly investigate the crash?
Even outside public roads, investigators should examine the scene carefully. How was the dirt bike being operated at the time? Was there evidence of braking or swerving? Was the rider aware of the person in the field, or did the collision occur without time to react? Documenting those details is necessary to understand the full sequence of events.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
A Honda dirt bike is vulnerable to sudden failures that could reduce control. A stuck throttle, brake malfunction, or steering issue might have made it impossible for the rider to avoid hitting the individual. If the bike was removed or worked on before being inspected, the chance to confirm or rule out a defect may already be gone.
3. Has all the electronic data relating to the crash been collected?
While most dirt bikes don’t store electronic crash data, other sources could be useful. Phones, GPS trackers, or even cameras on the property may provide context about how the bike was moving before the collision. Preserving that information quickly is the only way to separate assumptions from facts.
Private property doesn’t mean private answers. Any serious incident deserves the same level of investigation, because only by asking the right questions can the cause be truly understood.
Takeaways:
- It’s not clear whether investigators reconstructed the dirt bike’s actions before the collision.
- A possible brake, throttle, or steering issue may not have been ruled out.
- Digital data or property cameras could provide key details if reviewed.
