Commentary by Attorney Michael Grossman
When I read about a crash like this, the first thing I want to know is why the dump truck reportedly failed to yield the right-of-way. That single unanswered question determines a lot about responsibility, but the reports so far don’t say whether the driver was distracted, unable to stop in time, or dealing with some other circumstance. Without that, we’re left guessing.
In my experience, figuring out the “why” requires more than looking at the intersection after the fact. Investigators should secure the dump truck’s engine control module (“black box”) to see how fast it was going, whether the brakes were applied, and if there were any mechanical warnings in the moments before the collision. If there’s a dash cam, that could answer questions about visibility, timing of the traffic signals, or whether anything else influenced the driver’s actions.
It’s also important to look into the driver’s background and the company’s operating practices. Was the driver properly trained? How many hours had they been on the road that day? Were there deadlines or delivery schedules that might have pressured the driver to take risks? In past cases I’ve handled, problems with hiring practices or unrealistic scheduling have played just as big a role as a single driver’s mistake.
Right now, there’s no public word on the condition of the injured driver or on any findings from the investigation. Until all the evidence is collected and analyzed, no one can say with certainty who is responsible. That’s why gathering physical data, electronic records, and witness accounts early is so critical—it’s the only way to replace uncertainty with answers.
Key Takeaways:
- The main unanswered question is why the dump truck reportedly failed to yield the right-of-way.
- Black box data, dash cam footage, and cell phone records could help determine the driver’s actions.
- Company hiring, training, and scheduling practices may also be relevant to understanding the crash.
- A full investigation is the only way to establish responsibility with confidence.
