Commentary by Attorney Michael Grossman
The cause of the crash can’t be confirmed right now, and it’s important investigators consider the possibility the victim couldn’t avoid this crash. There may have been mechanical issues, road hazards, a tire blowout, manufacturing defects, a medical emergency, etc. Likely or not, a proper accident reconstruction should at least be able to rule those out.
I bring this up because people have a tendency to just automatically blame drivers involved in single-vehicle wrecks. Frankly, that’s because driver error is the most likely explanation. For example, a significant portion of our firm’s cases against alcohol providers over-serving drivers who get into an accident have involved single-vehicle wrecks. But there were also single-vehicle wrecks involving factors like those mentioned above which drivers had little to no control over. So unless there is clear evidence to explain what happened here, it’s best folks just avoid jumping to conclusions.
