Commentary by Attorney Michael Grossman
A crash like this one raises some immediate questions about the decisions and conditions that led to the collision. These types of accidents often boil down to visibility, timing and awareness
One key question is whether the truck driver saw the motorcycle before attempting the turn. Motorcycles are smaller and harder to see than cars, especially at night. However, truck drivers are held to a higher standard of care due to the size and potential danger of their vehicles. Did the truck driver adequately check for oncoming traffic before making the turn? Were they in a hurry to exit the truck stop and misjudged the motorcycle’s distance or speed?
The truck stop’s location near Interstate 65 is also worth examining. Was this intersection designed to safely handle the size and turning radius of semi-trucks? Poorly designed entrances and exits from truck stops can create dangerous conditions for all road users, especially if sightlines are obstructed or if the turning lane is too short.
Additionally, visibility may have been a factor given the time of the crash. It’s important to know whether the area was well-lit and whether both vehicles’ lights were functioning properly.
Finally, while it’s easy to focus on the truck driver’s actions, the trucking company’s policies and practices might also need review. Were they pushing their drivers to meet tight schedules, potentially leading to rushed decisions? Was the driver adequately trained to handle complex turns at night?
This crash highlights the importance of ensuring that commercial truck drivers are vigilant when navigating intersections, particularly at night. It also underscores the need for well-designed roadways near high-traffic areas like truck stops. Investigating these aspects thoroughly is the only way to determine what went wrong and how similar collisions can be avoided in the future.
