Police alleging that this may have involved a drunk driver may make things seem open-and-shut. However, that could make the investigations a lot more complex—if done right. Let me explain why.

Despite what many think, an investigation into a drunk driving accident doesn’t just involve looking at the alleged drunk driver’s actions. In Texas, it’s also important to know if a negligent alcohol provider unlawfully over-served that driver. When bars, restaurants, and other establishments over-serve someone who is obviously intoxicated, those alcohol providers can be held responsible if that intoxication leads to people getting hurt.

Too often, those negligent alcohol providers fly under the radar. I’ve handled hundreds of alcohol related accident cases. I rarely see authorities look into possible complicit alcohol providers on their own. In fact, I’ve had many cases where law-breaking establishments only ever faced charges because we found them in our investigations, then handed over all of our evidence to the authorities directly.

So, if alcohol was a factor here, holding the drunk driver accountable may just be the tip of the iceberg. Hopefully authorities are digging into what happened here beyond just what’s obvious at the scene. Otherwise, there may need to be more thorough independent investigations to ensure the victim sees full accountability for the harm done to them.
