Commentary by Attorney Michael Grossman
Moments that turn ordinary drives into emergencies can leave behind more questions than answers. In the wake of any serious crash, the immediate priority is getting help to those hurt, but the steps that follow can be just as crucial in understanding what really happened.
Did the authorities thoroughly investigate the crash? Given the complexity of an intersection collision, there’s no substitute for a full reconstruction effort. The vehicles’ directions, possible speeds and final positions all matter, and the scene should have been laser-mapped to preserve those details. Officers ideally would check for signs of distraction, delayed reaction times or failure to yield, each requiring more than a basic walkthrough. Not all agencies have the same resources or training to do this level of work, and that inconsistency can mean important evidence goes uncollected.
Has anyone looked into the possibility that a vehicle defect caused the crash? When a crash involves newer-model vehicles from different manufacturers, it’s wise to consider whether a mechanical or electronic failure played a role. Were the brakes working as expected? Did any pre-collision sensors attempt to warn or intervene? Even small malfunctions, especially ones tied to steering or acceleration, can make a major difference, but they often leave no visible trace. That’s why professional mechanical inspections are key, particularly before the vehicles are repaired or scrapped.
Has all the electronic data relating to the crash been collected? Today’s vehicles can tell a detailed story, if someone takes the time to pull the data. That includes braking input, speed and even lane position moments before the crash. Phones and GPS history might confirm if anyone was distracted or lost, while traffic camera footage could shed light on how the vehicles approached the intersection. If none of this digital evidence is reviewed, it’s hard to say whether the picture of what happened is complete.
Accountability isn’t just about assigning blame. It’s about understanding every piece of the puzzle. When serious injuries are involved, it’s not enough to rely on first impressions. Deeper questions lead to clearer answers.
Key Takeaways:
- Serious crashes deserve detailed reconstructions, not just basic reports.
- Vehicle malfunctions might not be obvious but still need to be ruled out.
- Electronic data from cars and phones can reveal what people miss.
