Commentary by Attorney Michael Grossman
There will obviously have to be an investigation into what happened here and how it could have been avoided. But knowing what led to a work accident is just one part of the challenge for the workers and their families. It's also crucial to anticipate what comes next. In Texas, that path forward is more complex than in any other state in the country.
Simply put, there is not always a guarantee that workers will receive benefits after an accident. Sometimes, getting those benefits requires going through a company's chosen process and criteria. As such, it's best when workers and their families have the evidence, tools, and legal strategy on their side to keep the playing field level and ensure their needs are being met. Hopefully those steps are being taken here.
