Commentary by Attorney Michael Grossman
Regardless of what happened here, it's important to understand why Texas work injury law is more complex than in any other state in the country. Simply put, there isn't always a guaranteed path for workers to get needed benefits after an accident.
People tend to assume workers' comp has everything covered, but employers in Texas are not required to subscribe to workers' comp. That means if a company is a non-subscriber, it's up to them to determine what they will or won't do to help out a worker who was hurt on the job. Instead of there being an automatic process, it's often up to the victims themselves to advocate for a resolution they feel is fair to their needs. This generally requires a lot of evidence, legal tools, and careful strategy the average person may not immediately have access to.
That's why, regardless of what happens in a Texas work accident, it's important for folks to know their rights, know what laws apply to their situation, and know what steps they need to take to navigate that legal maze.
