Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my first thought is that the driver’s loved ones deserve clear answers about what happened. A vehicle leaving the roadway and crashing into a body of water is not a common type of accident, and in my experience, these incidents often have underlying causes that aren’t immediately obvious. Before anyone can fully understand what led to this crash, three critical areas need to be examined.
First, did authorities conduct a thorough investigation? When a vehicle crashes through a barrier, it’s important to determine whether roadway conditions played a role. Was the wooden barrier properly maintained, or was it too weak to stop the vehicle? Was there clear signage warning of the water hazard ahead? Additionally, given that this happened on a stretch of road that loops up over the canal, did the design of the roadway contribute to the crash? A proper investigation should consider whether visibility, road markings, or even weather conditions at the time played a role.
Second, has anyone looked into whether a vehicle defect contributed to the crash? The Kia Sorento involved in this accident is a relatively new model, but mechanical failures can still occur. Did the vehicle experience unintended acceleration? Did the brakes fail or not respond as expected? Was there a steering malfunction that caused the driver to lose control? These are all possibilities that should be examined through a forensic inspection of the vehicle. Unfortunately, once a car is submerged in water, critical electronic evidence can be lost if investigators don’t act quickly to preserve it.
Finally, has all available electronic data been collected? Many modern vehicles, including the Kia Sorento, have an engine control module (ECM) that stores information about speed, braking and steering inputs leading up to a crash. If authorities were able to retrieve the vehicle’s ECM before water damage corrupted the data, it could provide valuable insight into what happened in the moments before the crash. Additionally, surveillance cameras from nearby businesses, traffic cameras or even witness cell phone recordings could help confirm whether the vehicle’s movements were intentional or the result of a mechanical failure or medical emergency.
At the end of the day, this crash left a driver dead, and the least the community owes his loved ones is a full and thorough investigation. If any of these three questions remain unanswered, there’s a real possibility that key details are being overlooked. Until we know exactly what happened and why, the family simply doesn’t have the full story.
