Commentary by Attorney Michael Grossman
With any motorcycle accident, one of my main concerns is if the investigations are being handled fairly. Unfortunately, a lot of people are negatively biased against motorcyclists. Even authorities sometimes jump to conclusions rather than letting the evidence speak for itself. Insurance companies know this all too well, which is why I always advocate for thorough independent investigations so adamantly.
At the end of the day, bias can only go so far when met with clear, convincing evidence. I've had numerous cases where our independent investigations into a motorcycle wreck were able to combat blame-shifting and even correct mistakes on official reports. That left as little room as possible for an insurance company to exploit any kind of biases or muddy the waters.
Perhaps authorities here have been more careful to let the facts speak for themselves. However, it's not the sort of thing I'd ever take for granted.
