Commentary by Attorney Michael Grossman
When a fatal accident involves multiple vehicles and complex circumstances, a thorough investigation is essential to determine how and why the crash occurred. In my experience, addressing such incidents requires careful attention to three critical questions.
First, did the authorities thoroughly investigate the crash? A motorcycle colliding with a vehicle, losing control, and then being struck by another vehicle is a complex sequence of events that demands meticulous analysis. Investigators should examine physical evidence, such as tire marks, debris patterns, and the vehicles’ final positions, to reconstruct what happened. Witness accounts and any available surveillance or dashcam footage are invaluable for clarifying the sequence of events, particularly in understanding how the motorcycle’s passing maneuver and subsequent loss of control unfolded.
Second, has anyone considered whether a vehicle defect might have contributed to the crash? While the sequence described suggests rider behavior may have played a role, mechanical issues cannot be ruled out without proper examination. A forensic inspection of the Kawasaki motorcycle is essential to identify any potential failures, such as brake malfunctions, throttle irregularities, or tire issues, that may have contributed to the loss of control. Additionally, the Chrysler and Nissan involved should be examined to confirm their safety systems operated as intended, particularly the Altima given its involvement in the second impact.
Finally, has all relevant electronic data been collected? Modern vehicles like the Kawasaki motorcycle, Chrysler, and Nissan Altima are typically equipped with event data recorders (EDRs) or similar systems that capture vital information, such as speed, braking, and steering inputs, in the moments leading up to the collision. This data could provide valuable context, clarifying whether the movements of the vehicles were consistent with driver input or indicative of other issues. Additionally, any nearby traffic cameras or surveillance footage could help provide a more complete understanding of the circumstances that led to the crash.
Accidents involving severe outcomes, such as fatalities, require comprehensive investigations to uncover all contributing factors. By addressing these questions, investigators can work toward providing a clearer understanding of what happened and why. A thorough investigation is the least that can be done to ensure every possible factor is carefully examined. For the loved ones of Guillermo Flores Ascencio, obtaining these answers is an essential step toward clarity and closure.
