Commentary by Attorney Michael Grossman
When someone on foot is hit by a vehicle, there’s often a tendency to assume the situation is straightforward. But events like these rarely unfold without a mix of contributing factors, some of which might never come to light unless someone goes looking for them. That’s why it’s important to ask whether everything that should be examined actually has been.
Did the authorities thoroughly investigate the crash? Initial reports often provide only a surface-level account. In cases like this, the real question is whether investigators used advanced tools to reconstruct the crash. Was the vehicle’s path mapped and analyzed? Did anyone look into the driver’s conduct prior to impact, like potential distractions, braking response or speed? Not every investigative team is trained the same way, and some serious collisions are evaluated without the depth they warrant.
Has anyone looked into the possibility that a vehicle defect caused the crash? When someone is hit during a turn, it's worth considering whether the vehicle responded as expected. A slow-to-respond brake, faulty steering input or even a malfunctioning sensor could be a factor. Unless the SUV was subjected to a full mechanical inspection, there’s no way to be sure it performed the way it was supposed to.
Has all the electronic data relating to the crash been collected? Today’s vehicles often store a surprising amount of useful information. That can include whether the driver applied the brakes, how fast the vehicle was going and whether any automated safety systems were active. If data from the vehicle, surrounding traffic cameras or mobile devices hasn’t been pulled and reviewed, the picture remains incomplete.
It's one thing to document the outcome of a serious incident. It's another to fully understand what led to it. A careful look at vehicle performance, driver behavior, and digital evidence isn’t just helpful. It’s necessary to reach accurate conclusions.
Key Takeaways:
- Surface-level crash reviews often miss key details without a full reconstruction.
- Vehicle defects can play a role even when no warning signs are obvious.
- Electronic data is essential to understanding what actions were taken, or not, before impact.
