UPDATE: (April 1, 2024): The man who lost his life as a result of this accident has been identified as 42-year-old Isidro Ruiz Jr. of Fabens, Texas. Authorities also say the other driver involved was allegedly intoxicated at the time of the crash, and he has been arrested for murder.
Commentary by Attorney Michael Grossman
If those allegations are true, authorities are clearly taking the criminal investigations very seriously. But my concern is they’ll be so focused on the allegedly intoxicated driver that they’ll overlook the possibility of an accomplice who also contributed to a man losing his life: a bar.
Simply put, intoxicated drivers at this time of day are almost always drunk (as opposed to on drugs), and they’re often on their way home from a bar. Well, in Texas, bars and other alcohol providers can break the law by over-serving those drivers, and they can then be on the hook when their illegal actions end up getting people killed.
This is an especially crucial area of the law because it both holds wrongdoers accountable and makes our roads safer. In just about every wrongful death case against an alcohol provider I can recall, the criminal investigations, liability, and fines and other penalties they faced made them clean up their act. The families in those cases were always satisfied to see justice done for their hardships, but it was just as relieving to know they helped prevent other families from suffering similar fates.
Unfortunately, in many of those cases, authorities were no where to be found until we brought the negligent alcohol providers to their attention. That meant that had the victims’ families relied solely on authorities to address these problems, those alcohol providers likely would have escaped consequences, allowing them to continue breaking the law until more people got hurt.
If authorities really wanted to do right by victims and their families, they’d ensure all parties responsible for the crash faced appropriate consequences. Are authorities here taking those steps?
