Commentary by Attorney Michael Grossman
With any single-vehicle accident, it's important to know whether or not investigations were thorough. Unfortunately, these accidents aren't always seen as a priority for police departments, so important details sometimes slip through the cracks if investigations aren't thorough enough. That's why it can be important to ask key questions early on.
The first question to ask is whether investigators had the right tools and enough time to fully assess the scene. Without proper equipment or staffing, critical details like vehicle position, road surface conditions, or evidence of evasive action can be missed, making it harder to put a clear narrative together.
It’s also important to consider whether a vehicle defect may have contributed. Issues like brake failure, steering malfunctions, or tire problems can lead to a rollover but won’t be identified unless the vehicle is closely examined before it’s moved or repaired.
Finally, was the vehicle’s electronic crash data preserved? Many vehicles store valuable pre-crash data—such as speed, braking, and steering input—that can help clarify what really happened. But that data must be collected quickly before it’s lost.
These questions can give authorities an opportunity to offer clear answers and show they've been thorough in their efforts. Otherwise, if it turns out their efforts come up short, steps can be taken to see there is a second set of eyes looking things over to ensure nothing important slips through the cracks.
