Commentary by Attorney Michael Grossman

When it comes to a single-vehicle wreck like this, there’s always a concern about how thorough the investigations have been. Especially early in the morning, authorities may not have a lot of obvious information to work with, meaning it’s crucial their accident reconstructions are meticulous. Unfortunately, I’ve experienced countless situations where authorities came up short, which is why I’ve found there are some key questions that can help gauge if there should be a second set of eyes on a given accident.

The first question is whether investigators had the necessary time, tools, and expertise to thoroughly analyze the crash. Single-vehicle accidents, especially in rural areas during the early morning hours, can be influenced by subtle factors like road conditions, unexpected obstacles, or environmental issues such as limited visibility. Did investigators carefully examine tire marks, document debris, or consider whether the vehicle’s path indicated an evasive maneuver? Without a detailed review, crucial details may go unnoticed, leaving key questions unanswered.

The second question is whether anyone has looked into the possibility of a mechanical issue or safety system failure. Defects like faulty brakes, steering malfunctions, or tire problems can cause a vehicle to lose control. Beyond that, equipment like seatbelts or airbags that fail to function correctly can make a crash far deadlier than it otherwise would have been. A thorough inspection of the vehicle is necessary to identify any potential failures and ensure those findings are preserved.

Finally, it’s essential to determine whether electronic data has been secured. Vehicles today contain Engine Control Modules (ECMs) that record valuable information about actions like braking, speed, and steering in the seconds before a crash. Data from GPS devices, cellphones, or nearby cameras can also help clarify the sequence of events. Preserving this evidence promptly is critical to prevent it from being lost or overwritten.

All said and done, authorities are sometimes able to provide satisfactory responses to these sorts of concerns. That’s usually a sign they were thorough and took the time to make sure they left no stone unturned. Other times, though, their answers don’t add up, or families are still left with unanswered questions. That’s when they can take steps to get another set of eyes on the facts to ensure nothing important slips through the cracks.
