Commentary by Attorney Michael Grossman
Head-on collisions often raise difficult questions about why two vehicles ended up in the same lane and whether anything could have prevented the outcome. When a passing maneuver results in two lives lost, it's important that the investigation looks beyond the obvious.
1. Did the authorities thoroughly investigate the crash?
A passing attempt on a hill suggests limited visibility, making it critical that investigators piece together the timing and positioning of both vehicles. Mapping skid marks, gathering witness statements, and analyzing how much space was available for the maneuver are all key steps to understanding why this collision occurred.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Even when driver decisions appear to play a role, mechanical issues can't be overlooked. A stuck throttle, faulty steering, or brake problems in either vehicle could have influenced the Mustang’s ability to safely return to its lane or the Maxima’s ability to avoid impact. A detailed inspection of both vehicles can help clarify whether equipment failure played a part.
3. Has all the electronic data relating to the crash been collected?
Data from both vehicles, including speed, throttle input, and braking, can help confirm what happened in the moments leading up to the impact. Any dash camera footage or nearby surveillance video could also provide valuable context for the investigation.
Fully understanding this crash is about more than noting that one driver attempted to pass—it’s about making sure every possible factor, human or mechanical, is accounted for.
Takeaways:
- Investigators should carefully reconstruct the timing and position of both vehicles during the passing attempt.
- Mechanical issues in either car must be ruled out before drawing final conclusions.
- Vehicle data and camera footage can help clarify the sequence of events leading to the head-on collision.
