Commentary by Attorney Michael Grossman
After any serious car accident, it's important to make sure investigators are covering all sides of the story. It's important that the evidence is able to speak for itself when there could be conflicting statements about what went wrong. A few key areas are often central to achieving this.
One of the first things to determine is whether authorities had the tools and time to properly document the crash scene. Intersections can be especially tricky to investigate, and if vehicle positions, debris fields, or traffic signal timing weren’t carefully recorded, key facts could already be missing.
Second, has anyone looked into whether a vehicle defect may have played a role? Issues like brake or steering failure can make it impossible for a driver to avoid a collision. On top of that, if seatbelts or airbags didn’t perform correctly, injuries could be more severe than expected. These kinds of problems require a thorough inspection that doesn’t always happen unless someone calls for it early on.
Lastly, was electronic data from the vehicles preserved? Many modern cars log pre-crash details—like speed, braking, and steering input—that can help clarify what happened. Combined with possible phone records or nearby surveillance footage, this data can fill in important gaps—but only if it’s secured promptly.
If authorities have looked into these things, it's generally a sign they're conducting thorough investigations. But if it seems they skipped over some of these details, then it may there needs to be more thorough independent investigations to get the whole story.
