Commentary by Attorney Michael Grossman
When analyzing a crash like this one, it’s critical to ask questions that help uncover all contributing factors. To understand what happened and why, we must focus on three key areas: the thoroughness of the authorities’ investigation, the possibility of a vehicle defect and whether all electronic data from the vehicle has been preserved.
First, the scope of the investigation must be assessed. Reports indicate that the vehicle struck a guardrail before rolling down an embankment, but it’s unclear what caused the driver to lose control. Investigators should consider factors such as road conditions, visibility and whether the guardrail functioned as designed. Was the road surface wet or otherwise hazardous? Was the guardrail positioned and maintained to effectively prevent vehicles from leaving the roadway? A detailed accident reconstruction, including the collection of evidence like skid marks and damage patterns, is critical to answering these questions.
Second, the possibility of a vehicle defect must be explored. A failure in critical systems like brakes, steering or stability control could have contributed to the vehicle’s loss of control. Additionally, the vehicle’s structural integrity during the rollover should be examined to determine whether it provided adequate protection to its occupants. For example, did the roof crumple as expected to absorb impact forces, or did its failure contribute to the severity of the injuries? Preserving the vehicle for a comprehensive forensic inspection is essential to uncovering potential defects that may not be immediately apparent.
Finally, securing and analyzing the vehicle’s engine control module data is vital to understanding the crash dynamics. ECM data can provide crucial information about the vehicle’s speed, braking, and steering inputs leading up to the collision. This data can help determine whether the driver attempted to avoid the guardrail or if the vehicle behaved unexpectedly. Additionally, if nearby traffic cameras or surveillance systems captured the crash, that footage could provide an external perspective on the vehicle’s movement and help corroborate other findings.
By addressing these three critical areas, we can work toward a complete understanding of what caused this crash. This process not only helps provide answers to those affected but also informs steps that could be taken to improve road and vehicle safety, reducing the likelihood of similar incidents in the future.
