Commentary by Attorney Michael Grossman

People tend to think that OSHA handles every aspect of a fatal work accident, but that’s not really how things work. Their priority is to find potential rule violations and issue fines. Those needs do not necessarily align with a worker’s loved ones who may be tasked with building a case to get needed benefits after losing a loved one in a fatal work accident. In Texas, that’s far from straight-forward.

In Texas, not every employer subscribes to the workers’ comp system. Getting a fair resolution, then, can involve navigating a legal maze that’s more complex than in any other state in the country. That’s why it can be prudent to seek out the right legal tools and strategies early on rather than just waiting around for OSHA. At the end of the day, a victim’s family needs their own evidence and their own approach that OSHA alone isn’t likely to provide.
