Commentary by Attorney Michael Grossman

When a single-vehicle crash leads to a fatality, especially on an open stretch of road, it’s important not to settle for simple assumptions. Just because no other vehicles were involved doesn’t mean the cause is obvious—or that everything that should be investigated has been.

1. Did the authorities thoroughly investigate the crash?
For a vehicle to leave the road and strike a tree, something had to go wrong—whether in the vehicle, the environment, or with the driver’s ability to respond. Did investigators map the path the Honda TRX took before impact? Was there any evidence the driver tried to brake or steer away? Not all crash scenes get the benefit of deep technical analysis, and when that happens, key details can get lost early on.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?
In crashes involving off-road or recreational vehicles like the TRX, mechanical reliability is especially important. Could a control issue or tire failure have caused the vehicle to veer off course? Was there a problem with the suspension or braking system? These vehicles are built to handle rough terrain, but they’re not immune to defects—and if no inspection is done, those possibilities go unexplored.

3. Has all the electronic data relating to the crash been collected?
While vehicles like the Honda TRX don’t always have the same data recording systems as cars, some do carry onboard modules that track speed and engine response. Did anyone check for stored data that might explain what the vehicle was doing just before it left the road? If a GPS device or phone was in use, those could also offer clues about the sequence of events. That kind of information can be critical—but only if someone makes an effort to retrieve it.

Unwitnessed crashes can quickly be labeled as unfortunate one-offs. But until someone examines the evidence with care, we’re left with more questions than answers—and that’s not good enough when a life has been lost.

Takeaways:

  • Even off-road vehicles deserve full crash investigation when the cause is unclear.
  • Mechanical failures can happen in any type of vehicle and should be ruled out.
  • Digital data from devices or vehicle systems may help explain how the crash unfolded.
