Commentary by Attorney Michael Grossman

Authorities alleged that the driver of the Honda was under the influence of alcohol when the crash occurred and recommended charges for intoxication assault. What I’m wondering is if they continued those investigations to find out where the driver got their alcohol.

In my experience, drivers charged for intoxication assault—especially this late at night—are often on their way home from a bar. Those bars need to be investigated, too, because they may have illegally over-served the drunk driver and contributed to the accident. That opens them up to possible consequences, including criminal charges, liability for the injuries, and fines and license suspensions. If authorities never looked into that here, they may be letting a dangerous local establishment off the hook.
