Commentary by Attorney Michael Grossman

When I see reports like this, my main concern is whether Jonathan Ross and those involved will get the answers they need about what happened. A rear-end collision might seem straightforward, but in my experience, these cases are often more complicated than they first appear. That’s why it’s essential to ask three key questions when examining any serious crash.

The first question is whether authorities have conducted a thorough investigation. Law enforcement will likely document the scene and consider factors like speed, distraction, and possible impairment. However, not all investigations are equally detailed, and important factors can sometimes go overlooked. Were there any roadway hazards or sudden traffic slowdowns? Were weather or lighting conditions a factor? Did officers have the necessary time and resources to reconstruct the crash properly? Answering these questions is essential to ensuring a full and accurate understanding of the crash.

The second question to consider is whether anyone has looked into the possibility of a vehicle defect. People often assume driver error in a rear-end crash, but mechanical failures can play a role. If the Honda’s brakes failed, if the throttle malfunctioned, or if an electronic system failed to respond correctly, those could be critical factors in understanding what happened. Unfortunately, crash investigations rarely consider potential defects unless someone pushes for that possibility to be explored. A forensic examination of the Honda could help determine whether a mechanical issue contributed to the crash.

Finally, it’s important to determine whether all relevant electronic data has been collected. The Honda’s engine control module may have stored valuable information about speed, braking, and throttle input before the crash. Additionally, nearby traffic or surveillance cameras could provide video evidence. Even cellphone data might be relevant if distraction played a role. The sooner this information is secured, the better chance it has of providing a clear understanding of what happened.

At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
