Commentary by Attorney Michael Grossman
When someone is seriously hurt and authorities believe alcohol was involved, it’s easy to assume the story begins and ends with the driver facing charges. But under Texas law, that’s not always the full picture—particularly if an alcohol provider may have played a role in enabling the crash.
Texas dram shop law allows for accountability not just for drunk drivers, but also for negligent establishments that serve alcohol to someone who is obviously intoxicated. If the driver in this case was over-served at a bar, restaurant, or similar establishment before getting behind the wheel, that business could share in the responsibility for what happened. The law recognizes that alcohol service isn’t just a transaction—it comes with real-world consequences when handled negligently.
Of course, it’s not always clear where the alcohol came from, and police investigations often don’t go that far. But that doesn’t mean those questions shouldn’t be asked—especially in a crash where a pedestrian was seriously hurt. If an alcohol provider contributed to this incident, identifying them could not only help bring full accountability but also prevent similar harms in the future.
Key Takeaways:
- When alcohol is involved in a serious crash, Texas law allows negligent alcohol providers to be held accountable—not just the driver.
- Investigating where the alcohol came from is critical but often overlooked in official reports.
- Dram shop accountability can pressure irresponsible businesses to change their practices before someone else gets hurt.
