Commentary by Attorney Michael Grossman
Even with a situation as concerning as an alleged wrong-way driving accident, it's always important to consider unusual possible factors a victim may not be able to avoid. For all we know, this all could have been the result of an emergency, poorly designed roads, or a lack of proper markings or signage, just to name a few examples.
That said, it's impossible to ignore that most crashes like the one described here end up involving alcohol. Even then, though, there could be more to the story. For example, I handled a case not long ago where a wrong-way driver was recklessly and illegally over-served by a bar, and that bar was still breaking the law until we saw them answer for their actions. Not only were they on the hook for the resulting crash, but they also opened themselves to criminal investigations and action from the Texas Alcoholic Beverage Commission.
Common or not, I've yet to see a reason for a wrong-way crash which didn't warrant every possible step to get the facts straight. If nothing else, there's a family out there who deserves answers. They shouldn't be left in the dark just because folks are desperate to blame someone. It's up to the evidence to speak for itself.
