Commentary by Attorney Michael Grossman
Any mention of alcohol is going to raise red flags, and people tend to think it’s just matter of charging the driver if they were drunk, and that’s that. In reality, crashes involving alcohol can get a lot more challenging if the driver was unlawfully over-served by an alcohol provider. For example, if someone walks into a gas station, is obviously intoxicated, and the clerk sells them a six pack anyway, the store can face consequences for that. This can include charges, fines, suspended licenses, and liability for injuries that alcohol causes. So while folks see alcohol-related accidents as open-and-shut, they can present significant hurdles if authorities aren’t taking the steps to investigate potential factors prior to the crash that played a role. It remains to be seen if authorities here are addressing those possibilities.
