Commentary by Attorney Michael Grossman
People tend to look at accidents like the one described here and assume they’re open-and-shut. After all, an alleged drunk driver as a pretty obvious bad guy (if the allegations prove true). What more is there to discuss? Well, a lot of the time, there’s an accomplice who also can be held responsible: a negligent alcohol provider.
To sum up all the legalese, it’s unlawful in Texas for alcohol providers like bars or restaurants to over-serve someone who is obviously intoxicated. Doing so can expose those establishment to potential consequences, especially if people are injured as a result. Victims and families can take steps to ensure those establishments are held accountable and clean up their act before more people get hurt.
The problem, though, is this often slips through the cracks. I can’t count how many times we looked into a drunk driving accident only to find authorities already moved on without bothering to investigate where the alcohol came from. This can be a serious oversight. It’s important both for those involved in an accident and for the community as a whole to see those negligent establishments answer for whatever role they may have played in a serious crash like this.
