Commentary by Attorney Michael Grossman
When a serious crash involving a passenger vehicle and an 18-wheeler occurs, a thorough investigation is necessary to determine exactly what happened. In my experience, getting to the bottom of an accident like this means asking three key questions: Did authorities conduct a thorough investigation? Has anyone considered whether mechanical issues or other external factors played a role? And has all available electronic data been collected?
Law enforcement will typically document the scene, but their reports may not always capture every detail. Did they examine why the Genesis collided with the back of the truck? Were roadway conditions, visibility, or truck lighting factors? Did investigators inspect the truck’s brake lights and reflective markings to ensure they were functional? These are important details that could affect what led to the crash.
Another consideration is whether mechanical issues contributed to the accident. If the Genesis experienced brake failure or a sudden mechanical issue, that could explain why it didn’t stop in time. Additionally, questions should be asked about the truck—was it moving at the time of the crash, or was it stopped in an active lane of travel? If the truck was stopped, was it properly marked to alert approaching drivers? These factors could significantly affect how the crash unfolded.
Finally, it’s critical to determine whether all electronic data has been collected. The Genesis may have an event data recorder (EDR) that could provide valuable insight into speed, braking, and steering inputs before impact. Similarly, the truck’s electronic logging device (ELD) and dash cameras, if available, could provide key context about its movements before the collision.
Accidents like this require a meticulous investigation to uncover every contributing factor. Addressing these questions ensures the incident is fully understood and provides a foundation for any necessary steps to ensure accountability. A thorough investigation is the least that can be done to provide clarity and closure for those affected.
