Kevin Wilkerson Killed, 2 Injured in Truck Accident in Yellowstone County, MT

The cause of the accident remains unclear. Officials indicate that, for as yet unknown reasons, a westbound 18-wheeler failed to safely maintain its lane of travel; it reportedly veered left, crossing over the center median and entering the oncoming lanes of traffic. There, it was first involved in a collision with an eastbound Volkswagen Rabbit occupied by a 19-year-old woman and as well as a 20-year-old. Following that impact, the truck apparently continued in the eastbound lanes of the interstate until it was involved in a secondary collision with the oncoming Chevrolet Suburban.

Wilkerson suffered fatal injuries due to the wreck. The 19-year-old from the Volkswagen and the 16-year-old girl from the Suburban sustained injuries of unknown severity, as well; they were transported to local medical facilities by EMS in order to receive necessary treatment. Additional details pertaining to this incident are not available at this point in time. The investigation is currently ongoing.

Commentary by Attorney Michael Grossman

When crashes like this occur, many are quick to attribute them to individual mistakes or unavoidable circumstances. However, based on my decades of experience handling commercial truck accident cases, wrecks of this nature often point to deeper systemic or operational issues that require thorough examination.

In this incident, reports suggest that the westbound 18-wheeler veered out of its lane and into oncoming traffic, causing a series of collisions. That raises critical questions about what led the truck to cross the median. Was the driver fatigued, distracted, or experiencing a medical emergency? Was there a mechanical failure in the truck, such as brake or steering issues? Or did road conditions, load distribution, or other external factors play a role? These are essential inquiries to understand the root causes of the crash.

It’s also vital to scrutinize the trucking company involved in this collision. Commercial carriers are legally obligated to ensure their vehicles are roadworthy and their drivers are qualified and adequately trained. Did the company comply with safety regulations regarding maintenance schedules and driver hours of service, or could lapses have contributed to the truck’s loss of control? Was the driver properly vetted and trained to handle a large vehicle under potentially hazardous conditions? Answering these questions is key to determining whether failures at the corporate level played a role in what happened.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
