Commentary by Attorney Michael Grossman
After accidents like the one described here, a major concern is if authorities are actually being thorough in their investigations. They may be quick to see an alleged drunk driver held accountable, but that doesn't do much to actually help the victims affected by the crash. That's why it's important to understand what Texas law says about drunk driving accidents and the possible legal avenues available to the victims and families.
For example, have investigators looked into where the alleged drunk driver had been drinking? In Texas, alcohol providers can be responsible for contributing to an accident caused by someone they unlawfully over-served. Bars, restaurants, liquor stores and the like can be held accountable, both giving the victims and families an opportunity to confront those negligent establishments as well as seeing the establishments face consequences so they clean up their act.
I've handled hundreds of cases against negligent alcohol providers. It's an area of the law that too often goes overlooked. That's why I have to wonder here if it's something authorities have considered or if there could still be more to this story.
