Commentary by Attorney Michael Grossman
When a collision at an intersection results in one vehicle overturning and another requiring extrication, the most important question is how the crash happened and whether it could have been prevented. My experience handling truck accident cases tells me that crashes at highway intersections often involve issues with visibility, right-of-way decisions and traffic control measures, all of which need to be closely examined.
One key question investigators should address is which driver had the right of way. Did one vehicle run a red light or stop sign? Was there confusion about who had the right to proceed? Some rural intersections rely on two-way stops instead of full traffic signals, which can create dangerous situations when drivers misjudge the speed of oncoming traffic.
Another factor is road design. Were there clear sightlines for both drivers to see each other before the impact? Some intersections have obstructed views due to terrain, trees or signage placement, making it harder for drivers to assess cross traffic. If this intersection has a history of similar crashes, that could indicate a need for improved traffic control measures, such as better signage, flashing warnings or even a full traffic signal.
The propane truck’s overturning also raises questions about vehicle stability. Propane trucks, like other tankers, have a high center of gravity, making them more prone to rollovers in high-impact collisions. Investigators should examine whether the truck’s load was properly secured and if the vehicle was traveling at an appropriate speed for the conditions.
While authorities continue their investigation, it’s essential to go beyond the immediate impact and consider all contributing factors — traffic control, road design and vehicle behavior — to determine what led to this crash. The victim's family deserves such answers.
