Commentary by Attorney Michael Grossman
Just because OSHA alleges that they found a violation here doesn't automatically mean this whole thing is open-and-shut. In fact, I've had cases where OSHA found all kinds of violations, yet they left the victim's loved ones complete in the dark with unanswered questions and no clear path toward a resolution. This would be less than ideal on its own were it not for Texas having the most complex work fatality laws in the country.
That's why families generally fare best when there are professionals on their side putting their needs first and getting clear answers about what happened. While OSHA and the authorities may put families low on their list of priorities, there are still options available to help those families navigate Texas work fatality law and get a just, fair resolution.
