Commentary by Attorney Michael Grossman
When accidents like this occur, people may assume they result from simple driver errors. However, in my experience, crashes involving passenger vehicles and large trucks often involve layers of contributing factors that require thorough investigation to fully understand what went wrong.
What might have caused the collision between the motor vehicle and the 18-wheeler? Did one or both drivers fail to exercise proper caution, such as maintaining a safe following distance or observing speed limits? Could mechanical issues, like brake failure or tire blowouts, have contributed to the crash? Understanding these factors is critical to piecing together the sequence of events that led to the incident.
Beyond the immediate collision, the trucking company responsible for the 18-wheeler must also be scrutinized. Trucking companies are responsible for ensuring their vehicles are roadworthy and their drivers are adequately trained to handle high-pressure or complex traffic situations. Was the driver adhering to hours-of-service regulations to prevent fatigue? Did the company properly maintain the truck, or did they cut corners to reduce costs? If systemic negligence or lax safety protocols played a role, those practices need to be addressed to help prevent future accidents.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
