Commentary by Attorney Michael Grossman

When I hear about a crash where a passenger vehicle crosses the center line and collides with a semi-truck, my first question is, “What caused the driver to veer into oncoming traffic?” Many people assume these incidents are simply driver error, but in my experience, there are often other factors that need to be carefully examined.

One of the first things investigators should determine is whether road conditions played a role. Was there anything on the highway — such as debris, potholes or ice — that could have caused the Saturn driver to lose control? Even something as simple as uneven pavement can lead to a sudden swerve, especially at highway speeds.

Another key factor is whether the vehicle experienced a mechanical failure. A tire blowout, brake issue or steering malfunction could have caused the driver to lose control. I’ve handled cases where drivers were blamed for crossing the center line, only for an inspection to reveal that a mechanical defect — something entirely out of their control — was the real cause.

At this stage, there are too many unanswered questions to determine exactly what led to this wreck, but that’s why a full investigation is necessary. Looking beyond the immediate facts will be key to understanding how this crash happened so the victim’s family gets the answers they need about her death.
