Commentary by Attorney Michael Grossman
In the quiet hours before sunrise, when traffic thins and most are home safe, the unexpected still finds a way to unfold. Crashes that happen at that hour often leave more questions than answers, and sorting through what really occurred requires more than just a surface-level review.
Did the authorities thoroughly investigate the crash? With a collision involving two modern vehicles and serious injury to at least one passenger, it's fair to ask how far investigators went in their review. Was the scene carefully reconstructed with the help of laser mapping or detailed vehicle trajectory analysis? Were the actions of both drivers in the moments before the crash fully explored? At 3 a.m., factors like fatigue or distraction may play a role, but identifying those requires more than just filling out a report. It calls for a methodical approach that not every investigator may have the training or resources to perform.
Has anyone looked into the possibility that a vehicle defect caused the crash? A crash involving a Kia and a Tesla introduces the possibility of different kinds of malfunctions. Did the Kia experience a brake failure, steering issue or unintended acceleration? Was the Tesla’s autonomous or driver-assist technology in use, and if so, did it perform properly? Mechanical inspections can be easily overlooked, especially when injuries shift the focus to immediate care. But without a close look under the hood and into the vehicle systems, key contributing factors might be missed.
Has all the electronic data relating to the crash been collected? These vehicles are likely to be rich sources of data, both from onboard systems and outside sources. From the Tesla’s telemetry to potential GPS data from both cars, and even nearby traffic cameras, a lot could help clarify driver behavior, speed and braking. Was any of it collected before the cars were released or repaired? Was phone use investigated? In a crash with unclear dynamics and injuries involved, digital evidence can make all the difference in understanding what really happened.
Accidents like this don’t always yield obvious answers at first glance. But real clarity comes from pushing past assumptions and taking a thorough, deliberate look at every angle. Without that, important truths risk staying buried.
3 Key Takeaways:
- A serious crash demands more than a routine review. It requires specialized crash analysis.
- Mechanical or electronic failures in modern cars shouldn't be ruled out without inspection.
- Digital data from vehicles and surrounding sources can reveal what the eye can’t see.
