Commentary by Attorney Michael Grossman
If the allegations here are true, then obviously it would make sense for there to be consequences for the alleged drunk driver. What people don’t often talk about, though, is how there could be an accomplice to all of this: a negligent alcohol provider. That’s important to consider after any drunk driving accident, but let me explain why these details make that possibility even more crucial to consider.
To put it simply, wrong-way accidents almost always involve intoxicated drivers because it’s difficult to get on the wrong side of the road without being in a significantly altered state of mind. In my experience, having handled hundreds of drunk driving accident cases, the amount of alcohol it take for someone not to realize what side of the road they’re on is extreme. That generally guarantees that the person was unlawfully over-served if they were drinking at a local establishment.
So, have authorities looked into that here? I can’t count how often a case with details like these has been brought to my attention, and authorities never bothered investigating anything beyond the crash scene alone. If there aren’t more thorough investigations into the events leading up to the crash, those affected by the accident may not get the answers nor the conclusion they deserve.
