Commentary by Attorney Michael Grossman
With authorities recommending charges here, people might think the situation is open-and-shut. But when alcohol allegedly leads to an accident, it’s important to find out where that alcohol came from. This is because there is often a negligent alcohol provider who is also responsible for contributing to the accident. Let me explain.
In Texas, it’s unlawful for bars, restaurants, and stores to serve someone who is obviously intoxicated. If the provider serves them anyway, and that leads to people getting hurt, the alcohol provider can be responsible for their role in the accident.
The problem is this area of the law too often goes overlooked. I’ve handled hundreds of cases against negligent alcohol providers. I can’t count how many times those negligent alcohol providers only faced consequences because we investigated beyond the accident scene and secured evidence of their wrongdoing that authorities completely missed.
That’s why I have to wonder if charging the alleged drunk driver here is really the end of the story. It’s important to find out where the driver was coming from. Not only does the victim here deserve to see all who harmed them held accountable, but also there could be a negligent establishment putting the community in danger. They, too, should face appropriate consequences so they don’t go on to harm anyone else.
