Right now, there are no reported charges or citations. However, if police really do believe the tractor-trailer here failed to stop for a stop sign, it may simply be a matter of time before charges are filed. That's a serious enough mistake as it is, but a professional truck driver is generally held to high standards in our legal system—for good reason.
Ask any experienced trucker and they'll tell you how difficult their job can be. They have a lot to handle, and even a small mistake can have dire consequences. For that reason, a lot of those truckers also have stories of drivers that didn't belong anywhere near their profession. Distracted driving, poor training, violating hours of service limits, failing to maintain the trucks, being reckless to meet ridiculous deadlines, and all kinds of other mistakes that get people killed.
One thing that remains to be seen here is what kind of mistake led to this terrible event. Could it be as simple as a negligent truck driver looking at their phone? Could it be something highly unusual like issues with signage at the crossing? Could it be a problem that reaches beyond this accident, such as a reckless employer that has other drivers capable of this kind of devastation? One way or another, there likely needs to be consequences here, and that's likely only going to happen once the full story is clear.
