Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the people affected get clear answers about what happened. A fatal motorcycle crash involving a vehicle pulling out of a parking lot is a type of incident that often gets chalked up to simple visibility issues or rider speed, but in my experience, those assumptions don’t always tell the full story. To understand what happened on State Highway 6, we need to ask three key questions that are often overlooked in the immediate aftermath.
First, did the authorities thoroughly investigate the crash? In collisions involving motorcycles and vehicles entering from side streets or parking lots, the details of timing, visibility and right-of-way are crucial. Did investigators conduct a full reconstruction to determine how far away the motorcycle was when the Infiniti entered the roadway? Were lighting conditions, line of sight and environmental factors carefully assessed? Did nearby businesses have cameras that captured the sequence of events? These details are essential to evaluating whether either party had a reasonable opportunity to avoid the collision.
Second, has anyone looked into whether a vehicle defect contributed to the crash? For the Infiniti, questions should be asked about whether the vehicle’s sensors or visibility aids were functioning correctly, especially if the driver was relying on backup cameras or blind spot monitoring systems. For the motorcycle, the 2023 Kawasaki Ninja is a high-performance machine: was it in proper working order? Were the headlights functioning as designed? Any mechanical failure, no matter how minor, could have affected the rider’s ability to be seen or to respond in time. Preserving both vehicles for a full mechanical inspection is essential before repairs or disposal.
Finally, has all the electronic data related to the crash been collected? The Infiniti’s engine control module may hold data about speed, throttle position and steering input at the time of the collision. Additionally, many newer vehicles also have systems that track proximity alerts and camera usage. For the motorcycle, while less data may be available, GPS information or data from a connected device could provide insight into speed and position. Surveillance footage from the surrounding area could also offer a clear record of the events leading up to the impact. All of this data must be preserved quickly before it is lost or overwritten.
This crash deserves a careful and methodical investigation. A man lost his life, and the initial facts raise important questions about timing, visibility and whether everything on both vehicles was functioning as it should have been. Only by asking these critical questions and preserving the right evidence can we get to the truth of what happened, and ensure those affected have the answers they deserve.
